Recurring Text Message Marketing 

Haggar Clothing Co. offers a text message marketing program (the “SMS/MMS Marketing Program”) for users who want to receive recurring marketing messages via texts to their mobile phone or mobile device number. If you choose to participate in the SMS/MMS Marketing Program, then you may sign up through our “Welcome” pop-up or here. By signing up for and participating in the SMS/MMS Marketing Program, you accept and agree to our Terms of Use and Privacy Policy as well as these Recurring SMS/MMS Text Message Marketing Program Terms (the “SMS/MMS Marketing Terms”)

Users who opt into our SMS/MMS Marketing Program consent to receive recurring, ongoing text messages from Haggar Clothing Company and haggar.com. These text messages may be sent by an Automatic Telephone Dialing System (“ATDS” or “autodialer”) and may include marketing, advertising, transactional, and other similar content, messaging, and communication about promotions, sales, discounts, loyalty programs, reward certificates, and other similar opportunities or offers directed to the mobile phone or device number provided when you opt into and join the SMS/MMS Marketing Program.

When opting into the SMS/MMS Marketing Program, you acknowledge and agree that message and data rates may apply. For information about messaging and data rates, please contact your carrier.

Haggar Clothing Co. and its affiliates are not responsible or liable for any delays in the receipt of any SMS or MMS messages. Delivery of SMS or MMS messages to your mobile device is subject to effective transmission from your network operator.

Text messages will not be sent to any one mobile number more than three (3) times per day. We adhere to state and federal restrictions when sending messages under the SMS/MMS Marketing Program.

Consent to participate in the SMS/MMS Marketing Program is not required for or a condition of your purchase of Haggar goods from Haggar Clothing Co., its affiliates, or other retailers or marketplaces that sell HAGGAR® branded goods.

Information you provide to Haggar through the SMS/MMS Marketing Program will be used by Haggar, subject to our Privacy Policy. That information will not be shared with third parties to enable those third parties to market their goods or services to you.

Participate / Opt In:Our SMS/MMS Marketing Program allows users to receive SMS or MMS mobile messages to their mobile phone or mobile device by affirmatively opting into the SMS/MMS Marketing Program, through online account creation or enrollment or by texting a keyword to the short code associated with the SMS/MMS Marketing Program (the “Short Code”), and confirming your consent to receive recurring text messages from us, and completing the sign-up instructions found in the related text message received. Sales and Sharing of Personal Information

We do not sell Personal Information about our customers for monetary value. When we use the terms sell, sale, or sold, we are referring to valuable consideration and not monetary value. We may share your Personal Information for cross-context behavioral or targeted advertising (together, “Targeted Advertising”). Targeted Advertising may be considered a sale under certain applicable state privacy laws.

We do not have actual knowledge that we sell or share the Personal Information of minors under sixteen (16) years of age.

Please note that we may request additional Personal Information to verify your identity. You may be able to designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed.

Request to Access and Data Portability. You may request that we confirm whether we are processing your Personal Information and request to obtain a copy of your Personal Information in a portable format.

Request to Correct. You may request that we correct inaccuracies in your Personal Information, taking into account the nature of the Personal Information and our purposes for processing it.

Request to Delete. You may request that we delete your Personal Information.

Request to Opt Out of Sales and Targeted Advertising. You may request to opt out of sales and/or Targeted Advertising. Please also note that if you choose to use the  Global Privacy Control (GPC) browser signal, you will only be opted out of online sales and sharing for targeted and cross-context behavioral advertising, and will need to turn it on for each browser you use.

Request to Opt Out of Profiling. You may request to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects. We do not use Personal Information for automated decision-making in furtherance of decisions that produce legal or similarly significant effects.

Request to Appeal. Sometimes we are unable to process requests relating to your Personal Information, in which case, your request will be denied. If you believe we denied it in error, you may appeal for reconsideration of your request using our webform or by calling us toll-free at 1 (800) 385-7939.

Please note that if you make a privacy request, we will retain the Personal Information submitted in connection with your request for recordkeeping purposes.

This section applies to California residents, and supplements the disclosures made in the Privacy Policy and State Notice, unless otherwise stated. For California residents, the disclosures in this Privacy Notice cover our current practices, as well as our activities in the twelve (12) months preceding the Last Modified date.

How Long We Keep Your Personal Information

We will store your Personal Information for no longer than is necessary for the performance of our obligations or to achieve the purposes for which the Personal Information was collected, or as may be required or permitted under applicable law. Right to Limit Use and Disclosure of Sensitive Personal Information. We do not collect, use, or disclose Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the CCPA.

Rights Related to Automated Decision-Making. You have the right to opt out of automated decision-making, including profiling, that we use to evaluate certain personal aspects relating to your performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.

Right to Non-Discrimination for the Exercise of Your Privacy Rights. If you choose to exercise any of your privacy rights under the CCPA, you also have the right not to receive discriminatory treatment by us.

California Notice of Financial Incentive

Haggar may operate promotional programs that offer financial incentives, including the Haggar Email Sign Up Rewards Program (“Email Sign Up Rewards”) and Account Creation Rewards Program (“Account Creation Rewards”). A financial incentive notice follows below. We may add or change programs and/or their terms by posting notice on the program descriptions, so check them regularly.

Account Creation Rewards are available to consumers who are sixteen (16) years of age or older, and discounts are redeemable only at haggar.com or participating retailers. Haggar collects your name, date of birth, and email to facilitate the Account Creation Rewards program.

Participating in the Account Creation Rewards benefit is entirely optional. You may opt in by providing your email address and name on our home page, haggar.com.

 

Value of the Consumer’s Data

The financial incentive we offer to adult consumers through the programs identified above is reasonably related to the value of the adult consumer’s data. Haggar has made a good faith estimate of the value of adult consumers’ data based on relevant expenses related to the collection and retention of adult consumers’ Personal Information as part of the programs above.

Withdrawing From Our Financial Incentive Programs

California consumers may make a Personal Information deletion request under the CCPA. The consumer will then be sent an email requesting that they confirm that they want to delete their respective program data. You may, however, terminate program participation at any time, as explained in each respective program’s terms or by calling us at 1 (800) 385-7939 or by emailing us at privacy@haggar.com. Upon a termination request, some program data associated with the terminated account may be retained for record keeping, tax reporting, and other legally permissible purposes. You can opt out of non-program marketing emails or delete your Personal Information from our active marketing lists and retain your program account and benefits.

California “Shine the Light”

We do not share Personal Information with third parties for those third parties’ own direct marketing purposes.
